In Utah, any driver with a blood-alcohol concentration – or BAC – above .08% is considered “per se intoxicated” under the law. Penalties involve suspension or revocation of your driver’s license by the Department of Motor Vehicles. After a driver is charged with a DUI, he or she has 10 days to submit a hearing request to the DMV, or this person will indefinitely have a license suspension. In Utah, for the original DUI offense the mandatory suspension is 90 days; for the second offense, one to two years; for the third offense, three years. Being charged with a DUI is no laughing matter.
